Years of unfiled returns? We’ve seen worse.

Failure-to-file penalties run 5% per month (capped at 25%) - plus interest, plus the risk of the IRS preparing a Substitute for Return (SFR) that ignores every deduction you’re entitled to. We reconstruct records, prepare past-due returns, and negotiate penalty abatement to minimize the financial damage.
Plain English

Why unfiled returns are a separate problem.

Unfiled returns aren’t the same as unpaid taxes. Even if you can’t pay, filing on time avoids the 5%-per-month failure-to-file penalty - which is ten times larger than the failure-to-pay penalty. The first move is always to file, not to wait until you can pay.

Years of non-filing also risks the IRS preparing a Substitute for Return on your behalf. SFRs use the IRS’s data only - wages reported by employers, 1099s - and ignore deductions, business expenses, and credits. The resulting balance is almost always inflated.

Clearing up the myths

Common misconceptions about unfiled taxes.

Many believe unfiled taxes can be ignored without consequences, but penalties and interest accumulate rapidly, leading to collections. Another myth is that only recent years matter, and the IRS can pursue returns over a decade old. Some think DIY filing is simple, but errors are common without expertise. BTR’s professional support ensures accurate filings and effective IRS negotiations, avoiding costly mistakes.

Bank statements, business records, deduction support - we rebuild what's missing so returns capture every legitimate write-off.

03

File

We prepare and submit every required year, in the right order, with all available deductions and credits.

04

Penalty abatement + resolution

We pursue first-time abatement on penalties and pair filing with the right resolution if a balance remains.

Why bring BTR in

DIY unfiled returns lose deductions.

When records are gone, most people accept the IRS's numbers. We reconstruct what's missing - bank statements, vendor receipts, mileage - so the return captures every legitimate deduction.

Records reconstruction

We pull bank records, request 1099/W-2 reissues, and rebuild expense documentation so every deduction is supported.

SFR replacement

If the IRS already filed an SFR, we can file a real return to replace it - typically reducing the balance significantly.

Penalty abatement

First-time abatement and reasonable-cause arguments are pursued aggressively. Penalty reductions often run into thousands.

Resolution included

If filing creates a balance, the same engagement covers Installment Agreement, OIC, or CNC - whatever fits.

Common questions

Unfiled returns FAQs.

How many years back do I need to file?+
The IRS generally requires the last 6 years for compliance, but if older years have balances or audits we may file more. Refunds can only be claimed within 3 years of the original due date.
What's a Substitute for Return?+
An SFR is a return the IRS prepares on your behalf when you fail to file. It uses only IRS-known income data and standard deduction - no business expenses, no itemized deductions. The resulting balance is almost always inflated. Filing a real return replaces it.
Will I owe penalties for filing late?+
Yes, but penalties stop accruing once you file. First-time abatement and reasonable-cause abatement can often eliminate or reduce them. We pursue both as part of the filing.
Could I face criminal prosecution?+
Extremely unlikely for typical non-filers. IRS criminal cases are reserved for willful tax evasion with significant fraud - not someone who got behind. Voluntarily filing back returns demonstrates good faith.
What if I can't afford to pay what I owe?+
Filing is still the first step. Once filed, we evaluate Installment Agreement, Offer in Compromise, or Currently Not Collectible to handle any balance.
